1. General Description
Fear Free, LLC (“Fear Free”) and Hopcat-Kansas City, LLC d/b/a Tiki Cat Veterinary Solutions (“Tiki Cat”) are sponsoring a contest in which Tiki Cat will send a sample product to every Fear Free Certified Veterinary Practice (each, a “Veterinary Practice”) and each Veterinary Practice will have the opportunity to submit a 60 second or less video to Fear Free and Tiki Cat for a chance to win the Prize (the “Contest”). Each Veterinary Practice that submits a video will become an entrant to the Contest (“Entrant”). At Fear Free and Tiki Cat’s sole discretion, one Entrant will be selected by Fear Free and Tiki Cat to receive a Tiki Cat prize package (the “Tiki Cat Prize Pack”). No purchase is necessary for an Entrant to enter into the Contest. Fear Free and Tiki Cat reserve the right to use any Entrant’s video in posts and content shared on Fear Free and Tiki Cat social media platforms, regardless of whether Entrant is selected as the winner of the Contest.
2. Rules and Regulations
Entrant unconditionally assigns and transfers to Fear Free and Tiki Cat all rights, ownership, title, interest and claim (including without limitation all copyrights), which it now has or may have in the future, to entries (including, without limitation, the submitted video), whether or not acceptable to Fear Free and Tiki Cat and regardless of the form they take, or any element(s) thereof and further grants to Fear Free and Tiki Cat the right to use, publish, exploit and/or modify any entry and/or video submitted in connection herewith in any manner it wishes, regardless if the media is now existing or hereafter created.
Fear Free and Tiki Cat reserve the right to edit and/or modify any Entrant’s video content or video titles. By entering, Entrant agrees to defend, release and hold harmless Fear Free and Tiki Cat and its agents from and against any claims, action and/or liability for injury, loss or damage of any kind resulting from Entrant’s participation herein (including in connection with the use and/or exploitation of the submitted video) or from the acceptance or use of any prize awarded. Fear Free and Tiki Cat reserves the right to verify eligibility qualifications of the winner.
Fear Free and Tiki Cat have the right to modify, use, assign or dispose of Entrant’s submission however they see fit without approval of Entrant or any third party. Entrant grants Fear Free and Tiki Cat the right to use their names, images, likenesses, photographs, voices and biographical materials, and video submissions, for advertising, publicity and promotion purposes including posting the videos or screen names online for any purpose or on a winner’s list and other online announcements, and for sharing the videos with the media for viewing, whether TV or print, without additional compensation, unless prohibited by law. Neither Entrant nor winner shall receive any compensation or credit for use of entries, other than that disclosed in these rules. Entrants agree that if selected as a winner, they grant Fear Free and Tiki Cat and its designees the right to film and later publish footage of the winner.
Fear Free and Tiki Cat are not responsible for incorrect or inaccurate transcription of entry information, or for any human or other error, technical malfunctions, lost/delayed data transmission, omission, interruption, deletion, defect, inability to access any online service or web site, or any other error or malfunction, or any injury or damage to Entrant or any other person’s phone or computer related to or resulting from participation herein, or for any injury to person or property, including but not limited to video equipment, arising from Entrant’s participation herein or for the use or misuse of any prize won. Fear Free and Tiki Cat are not responsible for lost, late, illegible or misdirected entries or mail.
Entrant warrants that their submission is original, that publication of the submission will not infringe on the rights of others, and Entrant has full power to grant ownership to Fear Free and Tiki Cat as stated herein.
Fear Free and Tiki Cat have no obligation of any nature to publish, promote, display or otherwise use any information provided by Entrants, including but not limited to biographical or video content.
3. Tiki Cat Prize Package
Subject to the terms herein, the Entrant that is selected by Fear Free and Tiki Cat will be awarded a Tiki Cat Prize Pack including 10 Tiki Cat Veterinary Solutions Stanley drinkware cups and product for the Entrant’s feline patients. The approximate retail value of the Tiki Cat Prize Pack is no more than $1,000. Fear Free and Tiki Cat reserve the right to substitute a prize of equal or greater value if an item in the Tiki Cat Prize Pack, or any portion thereof, is unavailable for any reason.
